These Terms of Service ("Terms") constitute a legal agreement between Space9X IT Services ("Space9X," "we," "our," or "us") and the user ("you" or "your") governing the use of our web hosting services. By using our services, you agree to comply with and be bound by these Terms. Please read them carefully.
1. Service Agreement
1.1. The Space9X Service Agreement is a separate agreement between Space9X and all customers. Please carefully review and agree to the Service Agreement and these Terms before signing up for or using Space9X’s services. Contact our sales department for any clarifications.

2. Resource Usage Policy
2.1. The Space9X Resource Usage Policy is an extension of these Terms containing specific utilization policies. Please ensure agreement with its points and conditions before using Space9X’s services. Contact our sales department for any clarifications.
3. Content
3.1. All services provided by Space9X may be used for lawful purposes only. Transmission, storage, or presentation of any information, data, or material in violation of any law is prohibited.
3.2. Prohibited content includes, but is not limited to, copyrighted material, threatening or obscene material, trade secrets, pornography, and illegal activities. Space9X reserves the right to determine violations and deactivate or remove any site at any time.
4. Copyright Violations
4.1. Space9X will respond to reports of infringement by the Digital Millennium Copyright Act. Notices must comply with relevant copyright laws. Space9X will act under the DMCA when handling infringement reports.
5. System Resource Usage
5.1. If an account is deemed to utilize an unacceptable amount of system resources, Space9X may temporarily deactivate or send an eviction notice, providing seven (7) days to upgrade or find a new provider.
5.2. Space9X is the sole arbiter of system resource usage violations.
6. Backups
6.1. Space9X performs nightly backups for administrative purposes only. Customers are responsible for maintaining their backups. Space9X does not guarantee the availability of backups.
6.2. Hosting accounts must not be used as a backup solution. Space9X may delete certain files for disk space reasons.
7. Unsolicited Email (SPAM)
7.1. SPAMming from a Space9X server or using a return email address on a Space9X server is strictly prohibited. Violations will result in immediate deactivation.
7.2. Intentional spammers may be billed for cleanup at $60/hour.
8. Support Abuse
8.1. Consistent demeaning or rude behaviour towards staff may result in account suspension. Termination for support abuse includes a ten (10) day notice.
9. Cancellations
9.1. Cancellations are processed by our Billing department. Requests must be submitted via the client area.
9.2. Cancellation requires acknowledgement of file and email removal. Space9X reserves the right to refuse reactivation until outstanding invoices are paid.
10. Payments and Billing
10.1. Renewal pricing notice is provided at least ten (10) days before the due date. Billing occurs seven (7) days before the due date.
10.2. It is your responsibility to ensure accurate billing information. Space9X reserves the right to refuse Services for accounts flagged for fraud.
11. Price Change
11.1. Space9X may change prices with at least thirty (30) days' notice for annual or longer-term plans.
12. Late Payments
12.1. Unpaid accounts have a seven (7) day grace period. Space9X may suspend and terminate Services after thirty (30) days.
13. Money-back Guarantee and Refund Policies
13.1. Money-back guarantee applies to specific services. Setup fees are non-refundable. External services are non-refundable.
13.2. Space9X account credits are non-refundable and expire after two (2) years.
13.3. Violations of this Agreement waive refund rights.
14. Free Migration Policies
14.1. Migrations are courtesy services. Space9X does not guarantee migration feasibility or the time required.
14.2. Free migration service is available for sixty (60) days. Migrations beyond this period incur charges.
15. Free Domain Name Policies
15.1. Customers on certain billing cycles receive a complimentary domain registration for one year.
15.2. Offer applies to specific domain extensions and hosting plans.
16. Prohibited Persons
16.1. Certain entities and individuals are prohibited from using our services based on applicable export and control laws.
16.2. Space9X does not register or allow the use of services for specific Country-Code Top Level Domain Names related to sanctioned countries.

17. Failure to Follow Policies
17.1. Failure to comply with these terms may result in account suspension or deactivation. Space9X reserves the right to remove any account without prior notice.
17.2. Space9X will turn over information about abuse incidents to the proper authorities.
By using Space9X’s services, you acknowledge and agree to these Terms. We reserve the right to update these Terms periodically, and your continued use constitutes acceptance of any changes. For questions, contact our sales department.
